Terms of Service

Last updated: April 5, 2025

1. Agreement to Terms

By booking a charter with Four Leaf Charters or using our website at fourleafcharter.com, you agree to be bound by these Terms of Service. Please read them carefully before making a reservation.

2. Bookings & Deposits

No deposit is required to secure your booking. Simply submit your reservation request and we will confirm availability with you directly. Full payment is collected on the day of your charter.

3. Payment

Full payment is due on the day of your charter. We accept cash, credit card, and Venmo. We do not collect payment information through our website.

Standard charter pricing covers up to 4 guests. Additional guests may be added at $50 per person, up to a maximum of 8 guests total.

4. Cancellation Policy

We understand that plans change. You may cancel your charter at no penalty provided you notify us at least 24 hours before your scheduled trip. Cancellations made less than 24 hours in advance may be subject to a cancellation fee at our discretion.

To cancel, please contact us directly by phone or email as soon as possible.

5. Weather & Captain's Discretion

Your safety is our top priority. If a trip is cancelled due to unsafe weather conditions, you will receive a full refund or the option to reschedule at no additional charge. The captain has sole discretion in determining whether conditions are safe to operate.

Minor weather such as light rain or wind that does not pose a safety risk will not automatically constitute a cancellation.

6. Guest Limits & Eligibility

Charters accommodate a maximum of 8 guests. Standard pricing covers up to 4 guests; a $50 per person fee applies for each additional guest beyond 4.

Minors are welcome aboard and must be accompanied by a parent or legal guardian at all times. The captain reserves the right to require a personal flotation device (PFD) for younger children.

7. Conduct on Board

All guests are expected to follow the captain's instructions at all times while on board. The captain reserves the right to end a trip early and return to dock without refund if any guest behaves in a manner that endangers the safety of others or the vessel.

Alcohol is not permitted on board at any time.

8. Assumption of Risk & Liability Waiver

Participation in fishing, boating, and water activities involves inherent risks. By booking a charter with Four Leaf Charters, you acknowledge and accept these risks on behalf of yourself and any guests in your party.

All guests will be required to sign a liability waiver in person before boarding. No guest will be permitted to board without a completed, signed waiver.

Four Leaf Charters is not responsible for personal injury, loss, or damage to personal belongings while on board, except where caused by our gross negligence.

9. Fishing Regulations

All fishing activities are conducted in compliance with Florida Fish and Wildlife Conservation Commission (FWC) regulations. Guests are responsible for adhering to all applicable size, bag, and season limits. A fishing license is not required for guests aboard a licensed charter vessel.

10. Photos & Media

During your charter, the captain may take photos of your trip. Some of these photos may be used for marketing purposes, including on our website and social media channels.

If you prefer that photos of you or your group not be used for marketing, please let us know before or at the start of your charter and we will respect your request.

11. Limitation of Liability

To the fullest extent permitted by law, Four Leaf Charters' total liability to you for any claims arising from your use of our services shall not exceed the amount you paid for the charter in question.

12. Governing Law

These terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts of Lee County, Florida.
